Terms of Service

Dungeon is non-custodial. We never hold your funds, we cannot move them, and we cannot recover them for you. Read this before you connect a wallet, swap, bridge, or buy anything.

1. Who you are agreeing with

These Terms are between you and Crypto Dungeon LLC, a limited liability company organized under the laws of the State of Iowa, United States, with its principal place of business in Dubuque, Iowa (“Dungeon”, “we”, “us”). By accessing or using any of the Services you agree to these Terms. If you do not agree, do not use the Services.

2. What the Services are

“Services” means the websites and interfaces we publish at dungeon.games and dungeongames.io and their subdomains, including the Dungeon DEX interface, the Hoard NFT marketplace, the block explorer, the Dungeon Wallet applications and browser extension, the BTC, Ethereum and Solana bridge interfaces, Dungeon Academy, and our games.

Most of what these interfaces do is submit transactions you have signed to dungeon-1, a public, permissionless blockchain, or to other public blockchains. The interface is a convenience. The blockchain, its smart contracts, and the validator set are what actually execute your transaction. You can interact with those contracts without us.

3. Non-custodial — we do not hold your assets

We do not take custody of your digital assets. We do not accept deposits, we do not process withdrawals, and we do not operate an order book or an exchange account in your name. You trade, provide liquidity, stake, bridge, and mint directly from a wallet you control, using keys we never see.

This has a consequence you must understand: if you lose your seed phrase or private key, your assets are gone permanently and we cannot restore them. No support request, identity check, or proof of ownership can reverse that. Back up your recovery phrase offline and never share it with anyone, including anyone claiming to be Dungeon staff.

4. Transactions are final

Blockchain transactions are irreversible once confirmed. We cannot cancel, reverse, refund, or amend a confirmed transaction, including one sent to a wrong address, one submitted with the wrong amount or slippage, and one that interacted with a contract you did not intend. Check every transaction before you sign it.

5. Eligibility

You must be at least 18 years old, or the age of majority where you live, and legally able to enter this agreement. Dungeon Academy accounts for minors must be created and supervised by a parent or legal guardian, who accepts these Terms on the minor's behalf.

You may not use the Services if you are located in, ordinarily resident in, or a national of any jurisdiction subject to comprehensive United States sanctions, or if you are listed on any United States government restricted-party list including OFAC's Specially Designated Nationals list. You are responsible for complying with the laws that apply to you, including tax and securities laws in your own jurisdiction.

6. Not financial advice, and not an offer

Nothing on the Services is investment, financial, legal, or tax advice. No content, statistic, APR figure, price, chart, or projection is a recommendation to buy, sell, or hold anything. $DGN and the other assets tradeable through the interface are utility and gaming tokens; nothing we publish is an offer or solicitation to sell a security in any jurisdiction. Do your own research and consult your own professionals.

7. Risks you accept

Digital assets are volatile and you can lose everything you put in. In addition, and without limitation, you accept the following risks:

  • Smart contract risk. Our contracts and the third-party contracts they build on may contain bugs or vulnerabilities that result in total loss. We have not commissioned a third-party audit of every contract in use.
  • Liquidity and impermanent loss. Providing liquidity to an automated market maker can leave you with fewer assets, or less value, than simply holding. Thin pools can move sharply on a single trade.
  • Bridge risk. Cross-chain bridges rely on external chains, relayers, signers, and threshold key material. A bridged asset can be delayed, stuck, or lost due to failure or compromise anywhere in that path.
  • Network risk. dungeon-1 is an independent chain. It may halt, fork, be upgraded, roll back, or suffer validator failure or attack. Displayed data may be delayed or wrong during such events.
  • Third-party data risk. Prices, market caps, and rankings shown in our interfaces may come from external providers and may be inaccurate or stale.
  • Regulatory risk. Laws affecting digital assets change and may restrict or end your ability to use the Services.

8. Market making and liquidity

We and our affiliates may hold $DGN and other listed assets, may provide liquidity to pools, and may operate automated market-making and liquidity programs that trade on Dungeon DEX. These trades settle on-chain as ordinary transactions and pay the same fees as anyone else's. We disclose this so that you do not assume all activity on a pool is unrelated third-party flow.

9. Games, NFTs, and digital items

In-game currencies, items, heroes, cards, and progress are licensed to you for use within the relevant game, not sold to you as property, except where an item exists as an on-chain NFT you hold in your own wallet. We may rebalance, patch, retire, or modify game systems and economies, and may correct account balances that resulted from a bug, exploit, or duplication. We do not guarantee any monetary value for any in-game item.

Where you purchase a subscription or digital product through Stripe, the relevant product page and checkout terms govern that purchase. Physical merchandise is covered by the Armory order policy.

10. Acceptable use

You agree not to:

  • use the Services to launder money, finance terrorism, or evade sanctions;
  • exploit a bug, contract flaw, race condition, or pricing error rather than reporting it to us;
  • manipulate a market through wash trading, spoofing, or coordinated deceptive activity;
  • attack, overload, scrape abusively, or attempt to gain unauthorized access to our infrastructure or another user's wallet or account;
  • impersonate Dungeon, our staff, or another user; or
  • use the Services in violation of any law that applies to you.

If you find a security vulnerability, please report it privately through Discord before disclosing or exploiting it.

11. Availability and changes

The Services are provided on an as-available basis. We may modify, suspend, restrict, or discontinue any part of the Services, including any interface, game, pool incentive, or bridge, at any time and without notice. Because dungeon-1 is a public chain, the underlying contracts may remain usable even if our interface does not.

12. No warranty

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, secure, error-free, or that any data displayed is accurate or current.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DUNGEON WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR DIGITAL ASSETS, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US DIRECTLY IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limitations above apply only to the extent permitted, and nothing in these Terms limits liability that cannot lawfully be limited.

14. Indemnity

You agree to indemnify and hold harmless Crypto Dungeon LLC and its members, officers, and contractors from any claim, loss, liability, or expense (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any law or third-party right.

15. Governing law and disputes

These Terms are governed by the laws of the State of Iowa, United States, without regard to its conflict-of-laws rules. You and Dungeon agree that the state and federal courts located in Dubuque County, Iowa have exclusive jurisdiction over any dispute arising from these Terms or the Services, and you consent to personal jurisdiction there. Any claim must be brought in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

16. Changes to these Terms

We may update these Terms. The “last updated” date above changes when we do. Continuing to use the Services after an update means you accept the revised Terms. If a change materially reduces your rights, we will make a reasonable effort to announce it in our community channels.
